When the Algorithm Says No: AI Hiring Tools and Employment Discrimination

An employer can be liable when an automated hiring or screening tool rejects you because of a protected characteristic. The law that forbids discrimination in hiring does not contain an exception for decisions made by software. When a company chooses to let an algorithm sort, score, or reject applicants, it remains responsible for the result, and a biased result is unlawful whether a manager or a model produced it.

This is the new front line of employment law, and it is where Atlas Law Center focuses. The questions are familiar at their core, but the evidence and the defenses are different when the decision maker is a system.

Why the employer is still responsible

Companies increasingly buy hiring tools from outside vendors, then argue that any unfair outcome is the vendor's fault. The law does not work that way. The employer that uses the tool to make decisions about real people carries the legal duty not to discriminate. Delegating the decision to a model does not delegate the responsibility for it.

That principle matters because it keeps the focus where it belongs. The worker harmed by a biased screen does not have to untangle the vendor relationship to hold the employer accountable.

Disparate impact in plain terms

Some automated tools never mention a protected characteristic and still produce discrimination. If a screening tool systematically rejects applicants of a particular race, sex, age group, or disability status at a higher rate, and the employer cannot justify that screen as necessary for the job, the result can be unlawful disparate impact. The tool does not have to be designed to discriminate. It only has to do so in effect.

What to do next

Many discrimination charges must be filed with the Equal Employment Opportunity Commission within 180 or 300 days. Is it legal for an employer to use AI to screen job applicants?

Using a tool is not itself illegal, but the result must comply with anti-discrimination law. If an automated tool rejects applicants because of a protected characteristic, or disproportionately screens out a protected group without justification, the employer can be liable.

Can the employer blame the software vendor?

No. The employer that uses the tool to make employment decisions remains responsible for the outcome. Pointing to a third party vendor does not erase the employer's legal duty not to discriminate.

How would I even know an algorithm rejected me?

It is often hidden, but signs include instant rejections, automated assessments, and references to a screening platform. Some jurisdictions now require employers to give notice or to audit these tools, and you can request information about how the decision was made.
